Terms and Conditions – NETVIGATOR and Now TV x Netflix Entertainment Super-Combo (with a Set-Top Box):

Netflix Terms & Conditions:
- This NETVIGATOR and Now TV x Netflix Entertainment Super-Combo (with a Set-Top Box) (“this Offer”) is a limited offer, only available to designated new NETVIGATOR consumer customers at designated housing estates with designated 2500M NETVIGATOR broadband service#(“Underlying Service”). The Underlying Service is provided by us, Hong Kong Telecommunications (HKT) Limited. Now TV service is provided by Now TV Limited. Netflix service is provided by Netflix Pte. Ltd. (“Supplier”).
- Under this Offer, eligible customers may subscribe to NETVIGATOR and Now TV x Netflix Entertainment Super-Combo (with a Set-Top Box) Netflix Standard Plan (which allows customers to watch on 2 supported devices at a time in Full HD) or Netflix Premium Plan (which allows customers to watch on 4 supported devices at the same time in Ultra HD and/or with Netflix spatial audio ) (“Service”, being the Now TV services and the Netflix service under the Designated Plan) with a not less than 24/36-month commitment period (“Designated Plan”), as an optional service of their Underlying Service. The Designated Plan also includes Now TV News Pack, a Now TV Set-Top Box and Netflix Standard / Premium Plan. The service fees payable for the Designated Plan will include installation charges or Now TV Set-Top Box HD/4K Connection and Set-Top Box Rental Service fee. The service fees for the Designated Plan will be billed under customer’s Underlying Service account.
- Customers can access the Netflix service via accessing Channel 535 on a designated Now TV Set-Top Box (including Set-Top Box of models H1, Now One 6950 and 6845), Netflix Website (www.netflix.com), Netflix App or the designated interface upon successful activation of the streaming service under the Designated Plan. Now TV Limited will provide one of the above-mentioned models of Set-Top Boxes that is compatible with Netflix to the new customers in its sole discretion.
- Upon subscription, Now TV Limited will send a SMS notification about the Netflix service redemption to customer’s registered mobile number on the Designated Plan’s effective date. To activate Netflix service, the customer is required to complete the activation process by entering the required information at Netflix website through the designated activation link provided by Now TV. Customers may follow the instructions via SMS; customers may also complete the activation process on https://www.nowtv.now.com/nowtv-netflix. The commitment period of the Designated Plan will commence on the date on which the SMS is sent out, whether the customer has activated the Netflix service or not.
- The Now TV services under the Designated Plan are provided to customers by Now TV Limited, subject to the “Terms and Conditions for Now TV News Pack (With a Set-Top Box)” (“Now TV Terms and Conditions”) (see below), and the Netflix service under the Designated Plan are provided to customer by the Supplier, and subject to the “Netflix Terms and Conditions” (“Supplier’s Terms and Conditions”) (see below).
- We are not the supplier of the Service and make no representation or guarantee to any aspect of the Service (including but not limited to its quality), and shall not in any way be liable to any matters in relation to the Service. No compensation shall be forthcoming by us in relation to the Service under any circumstances. For enquiry or dispute about Now TV services, please contact Now TV Limited directly on Now TV’s Customer Service at 1833 888. For enquiry or dispute about Netflix service, please contact the Supplier directly.
- The information and content about Netflix service are based on information provided by the Supplier. We do not in any way make any representation or guarantee as to its accuracy or completeness. Any reliance a customer places on such information is therefore strictly at the customer’s own risk. It is recommended that customer verify any important details directly with the Supplier before making any decisions or taking any actions based on this information.
- Customer’s Underlying Service and the Service are non-severable. If a customer’s Underlying Service is terminated for whatever reason, the customer’s Service under the Designated Plan will also be terminated immediately (however, Section 4 of “Netflix Terms and Conditions” below may apply).
- If the Service or the Designated Plan is terminated due to whatever reason before the expiry of the relevant commitment period, customer will be charged relevant early termination fees for the Service, which will be calculated as the sum of the monthly service fees of the Service for the remaining unexpired period (whereby less than one month shall be regarded as one full month for calculation purpose).
- NETVIGATOR broadband services and Now TV services are provided by us and by Now TV Limited respectively, and only cover designated areas, subject to relevant terms and conditions. For details, please see NETVIGATOR’s website at netvigator.com and Now TV’s website at https://nowtv.hk.
- We, Now TV Limited and/or the Supplier reserve(s) the right to vary or cancel this Offer and/or amend these Terms and Conditions at any time without notice. Now TV Limited reserves the right to amend the Now TV Terms and Conditions at any time without notice. The Supplier reserves the right to amend the Supplier’s Terms and Conditions at any time without notice.
- In the event of dispute in relation to this Offer, our decisions, Now TV Limited’s and/or the Supplier’s decision shall be final. In the event of dispute in relation to the Now TV service, Now TV Limited decision shall be final. In the event of dispute in relation to the Netflix service, the Supplier’s decision shall be final.
- 2500M bandwidth specifications relating to a 2500M fibre broadband plan refer to network specifications in respect of the services to which a customer subscribes for the broadband line connected from the modem at the customer’s premises to the first piece of NETVIGATOR network equipment or central office of the broadband network. A 2500M fibre broadband plan provides maximum upstream and downstream bandwidth of 2.5Gbps. Actual speeds experienced will be less than the network specifications suggest and will be affected by the customer’s device, technology, network and software used, network configuration and coverage, usage levels, international bandwidth and other extraneous factors. Equipment supporting 2500M broadband specification is required.
m. Terms and Conditions for Now TV News Pack (With a Set-Top Box):
- “Now TV News Pack” provides multiple international news and financial channels 24 hours a day. For details of “Now TV News Pack”, please refer to https://www.nowtv.now.com available-channel-packs.
- Customers may enjoy Now TV services through a Now TV Set-Top Box, Now TV App (including Now TV App on compatible mobile devices and/or specific smart televisions) and Now TV Website. A customer must provide an email address or mobile number for the purposes of creating and/or logging in to the customer’s Now ID account in order to watch Now TV programme content.
- All programme contents are subject to cancellation and/or suspension by the rights holders and/or event organisers. Dates and times of all programme content and events may be subject to change from time to time, so please refer to official announcements by the organiser for the latest information. Please note that Now TV Limited cannot guarantee the continued availability of the content, channels, programmes and/or services on the Now TV services for the entire duration of your subscription; and it shall not be liable for any failure, unavailability or delay in the broadcast, of any content, channels and/or programmes. For all services plan and offer details, please inquire with Now TV sales representatives.
- Provision of the Now TV services and Now TV News Pack (With a Set-Top Box) are subject to Now TV Things to know before you buy, Now TV Terms and Conditions, Now TV App/Website Terms and Conditions, Now TV Service Guide and Now TV Contract/Application Form. Netflix Terms & Conditions:
- The Netflix service is provided to customer by Netflix Pte. Ltd. (“Netflix”) under the Netflix Terms of Use, which will be provided to customer separately.
- In order to enjoy the Netflix service as part of the Designated Plan, customer will need to complete the Netflix activation process (Instructions will be provided separately).
- If a customer has an existing Netflix service account, customer can link it to the designated Now TV x Netflix Service Plan (with a Set-Top Box) when customer complete the Netflix activation process. Customer will continue to be charged separately for any existing Netflix service account until customer link that account to the designated Now TV x Netflix Service Plan (with a Set-Top Box). For any queries regarding your billing with Netflix for your existing Netflix service account please contact Netflix directly.
- Cancellation of Netflix as part of the designated Now TV x Netflix Service Plan (with a Set-Top Box) will not automatically cancel any pre-existing linked Netflix service account and Netflix will automatically resume charging any existing method of payment of yours that Netflix has on file. If customer wishes to review the details of customer’s Netflix membership please visit the ‘Account’ pages on the Netflix website.
